Legal and democratic
The legal and democratic services team is responsible for ensuring the legality of the Council's operations and is the core source of advice and support for the democratic processes of the County Council.

It does this by providing a high quality efficient and effective legal service to the Council, its committees, directorates, elected members and external partner client bodies. It is also responsible for supporting the promotion of high ethical standards within the organisation.

The team also supports the democratic decision making processes of the County Council, Executive, Committees, individual Councillors and officers of those bodies, and the appeal mechanisms to which everyone has equal access against decisions of officers of the Council.

Key work areas include:

  • Providing legal support to the Directorates in projects and initiatives to ensure the effective delivery of their services
  • Providing democratic and administrative support to the Council, Executive and Committees and ensuring effective decision making processes
  • Directly advising the Council, Executive and Committees, and individual members in their various roles;
  • Representing the Council in all legal forums, courts, tribunals and at inquiries;
  • Undertaking legal work across all local government work areas, in teams dedicated to:
    • Children's social care and protection
    • Partnerships, land transactions, adult social care and protection, and mental health, procurement and contracts
    • Education and employment
    • Planning, highways and economic development
    • Corporate governance and the development and maintenance of the Council's Constitution and governance frameworks;
  • Supporting the Standard's Committee in its promotion of ethical standards;
  • The conduct of elections on behalf of the Council

About legal and democratic services

Legal and democratic services

The legal services team consists of five teams (42 staff). As part of the legal services team, you would be responsible for:

  • The provision of legal advice to the Council and Executive, Committees, Directorates and Council Members on all aspects of local government law
  •  Representing the Council in courts and tribunals
  •  Advising members in relation to the Code of Conduct
  •  Maintaining the members register of interests
  •  The provision of a Legal service to external bodies such as the North York Moors National park Authority
  •  The maintenance of the Council's Constitution and other Governance frameworks
  •  Monitoring and advising on legislation

Most legal posts will require you to be a qualified solicitor who has excellent communication skills. Team members are required to write concisely and accurately at all times often having to explain detailed concepts and matters to 'lay people'. They must have an eye for detail, be good presenters, especially essential in court/tribunal settings.

The Democratic services team supports the work of the county council by:

  • Cycle-end Review of Education Admission Appeals
  • Review of Councillor and Committee information accessible via intranet and internet

The work principally involves the preparation of agendas and reports; attending council meetings to record the business undertaken; the production of formal minutes; liaison with other services within the council; and advising elected members on the democratic processes and procedures.
