Licence - scaffolding and hoarding

A scaffold or hoarding licence is required to use scaffolding or another structure to do building or maintenance work on or over a highway.

A scaffold or hoarding licence is issued for the occupation of the highway only. The responsibility for the safety of the scaffold lies with the scaffold company on the site who are responsible for all aspects of the scaffold in its entirety. This includes design, erection, dismantling, ties to buildings, lighting, netting and foundations.

Scaffolding or hoarding will not usually be authorised to be placed in the following locations:

  • On a carriageway or back street. Each scaffold or hoarding will be erected on the footway. Only in exceptional circumstances will scaffold or hoardings be permitted in such locations.
  • On a highway that has a traffic regulation order restricting the parking of vehicles on that section of highway.

Registering as a scaffold operator

A licence to place a scaffold on the highway can only be obtained by a scaffold company that is registered with the County Council.

Duration of a scaffold licence

A scaffold licence is valid for up to 4 weeks. As situations change, we may be notified of street works by a utility company or road closures may be required. A separate application is required for an extension to a scaffold licence.

Extending your scaffold or hoarding licence

On application, an extension to an existing licence may be granted for up to 4 weeks. The conditions of the original licence will also apply to the extension and an additional fee will be payable. When we receive an extension application we will check the location and dates again to see if the licence extension can be permitted.

Scaffold or hoarding licence conditionsIn accordance with the Highways Act 1980, the licence holder must secure compliance with the requirements and stated conditions whilst the scaffold or hoarding is on the highway.

Compliance and enforcement of scaffold or hoarding licence conditions

The County Council is responsible for ensuring the safety of the public highway; we must ensure that any request to place a scaffold on the highway does not represent a safety hazard.
