Skip permits
A skip can be placed on private property for example a residential driveway, without a licence. However, a skip licence is required to place a skip on the highway including all roads, footways, footpaths, verges and back streets.
If a skip is deposited on the public highway for which a licence has not been applied, the owner is guilty of an offence under section 140 of the Highways Act 1980 and is liable to a fine. Skips will not usually be authorised to be placed in the following locations: - On a footway or verge. Only in exceptional circumstances will skips be permitted in such locations.
- On the highway if it appears to the County Council that a skip could be reasonably placed on private property.
- On a highway that has a traffic regulation order restricting the parking of vehicles on that section of highway.
This is a requirement of the Highways Act 1980. The local authority has the right to specify conditions relating to the position of any builders' skips. It is not the responsibility of the customer (or their contractor) to apply for this type of licence. It is the responsibility of the Skip Hire Company to ensure that the licence has been applied for and that is has been granted. When we receive an extension application we will check the location and dates again to see if the licence extension can be permitted. | Skip licence conditions | In accordance with the Highways Act 1980, the licence holder must secure compliance with the requirements and stated conditions whilst the skip is on the highway. | Compliance and enforcement of skip licence conditions | The County Council is responsible for ensuring the safety of the public highway; we must ensure that any request to place a scaffold on the highway does not represent a safety hazard. |
