Guidance notes on the completion of the Agricultural Holdings Certificate

Please note the following:

  1. If any part of the land to which your application relates is an agricultural holding, or, part of one, you should give notice to any tenant or tenants of the holding, and certify that you have done so by completing the notice under Article 13.
  2. Where no tenancy is involved, you should certify that the land does not form part of an agricultural holding. 
  3. Where you or anyone else owns all the land to which the application relates and occupies it for agricultural purposes, you should certify that the land does not form part of an agricultural holding as there is no tenancy involved.
  4. There are alternative paragraphs at the end of the certificate, please note that the inappropriate paragraph must be deleted. 
  5. If you, yourself, are the agricultural tenant, you should complete Ownership Certificate B and serve notice on the owner of the land. 
  6. Two copies of the Agricultural Holdings Certificate should be signed, dated and submitted along with your application. 
  7. Your application will not be considered complete unless it is accompanied by two signed and dated copies of the Agricultural Holdings Certificate.

Important note: any person who knowingly or recklessly issues a certificate which contains a statement which is false or misleading in a material particular is guilty of an offence and is liable to a fine on conviction.
