Minerals and waste joint planning authorities

We are working with other authorities to produce a minerals and waste joint plan.

As minerals and waste planning authorities, North Yorkshire County Council, the City of York Council and the North York Moors National Park Authority have produced a minerals and waste joint plan.

The minerals and waste joint plan will, now finalised, set out new planning policies for minerals and waste developments across all three areas which will guide decisions on planning applications up to 31 December 2030.

The minerals and waste joint plan is intended to deal with key questions about future development such as:

  • where should future minerals and waste development be directed
  • when should future development take place and
  • what sort of development should take place and how should it be implemented

Engagement with the public, the minerals and waste industry and other organisations was a key part of the process and has enabled the authorities to take into account the views of those with an interest in the plan.

Why produce a minerals and waste joint plan

Advice and guidance produced by the government seeks to move towards enhanced working between local authorities on areas of common interest to achieve sustainable development. The nature of minerals and waste developments mean that often there are implications beyond individual planning authorities' boundaries.

North Yorkshire County Council, the City of York Council and North York Moors National Park Authority have decided to produce a minerals and waste joint plan so that strategic issues can be addressed on a greater than local level and to help comply with the 'duty to co-operate'. Production of a joint plan is also expected to be more efficient than producing three separate plans.

Timetable

North Yorkshire County Council adopted the Minerals and Waste Joint Plan at their Full Council meeting on 16 February 2022. An  adoption statement (pdf / 436 KB) has been produced. The North York Moors National Park Authority adopted the Plan on 21 March 2022 and the City of York Council adopted the Plan on 27 April 2022. The Inspector took into consideration the content of the Main Modifications Consultation responses while writing her report. The Authorities received the  Inspector's Report (pdf / 591 KB) and accompanying  Appendix (pdf / 2 MB) on 4 February 2022 which concluded that the Inspector found the Minerals and Waste Joint Plan sound. The Minerals and Waste Joint Plan was submitted to the Planning Inspectorate in November 2017. Hearings took place in the spring of 2018 and January 2019. The Authorities produced a Schedule of Main Modifications to the Publication Draft which was out for consultation between 21 July 2021 and 5pm on 15 September 2021 this consultation is now closed. Submission

The minerals and waste joint plan was submitted under Regulation 22(3) of the Town and Country Planning (Local Planning) (England) Regulations 2012 to the Department of Communities and Local Government on 28 November 2017.

Proposed changes to the minerals and waste plan publication document

Following the six week consultation in November 2016 a number of proposed changes were identified to the draft minerals and waste plan. As a result it is necessary to present the changes for feedback on legal compliance and soundness in an addendum of proposed changes. The consultation of the addendum of proposed changes is now closed. The documents that were included in the consultation are in the table below.

Minerals and waste plan publication period for representations November / December 2016

Following the minerals and waste joint plan preferred options consultation the responses, along with related evidence, were considered and used to help develop the final draft version of the plan for publication for representations on legal compliance and soundness. The period of time for making representations on the publication version of the minerals and waste joint plan is now closed. Any representations received after the deadline cannot be accepted as being duly made. However, we did forward any late representations to the planning inspector for their information. A copy of the documents presented as part of the publication period are available below for reference only. The representations submitted in response to the publication document were compiled and submitted as part of the submission documents. A table listing the respondents and a  copy of the submitted representations is available below, Due to the volume of representations received the representations have been split into four groups. A report containing a summary of the representations is also available below.
