Article 4 Directions are in force in the following areas.

Scarborough Old Town and Royal Crescent - restriction on dormer windows

Approved by the Secretary of State on 5 May 1975.

Area covered:

  • based on St Marys Walk.
  • based on St Sepulchre Street/Princess Street.
  • wholly within Royal Crescent

Works covered: 

The enlargement, improvement or other alteration of the dwellinghouse by the construction of dormer windows.

The Article 4 Direction remains in the statute book and should be revealed in searches. However, for practical purposes, it is superseded by the 1995 General Permitted Development Order.

Coastal district - restriction on the temporary use of land for open markets

Approved by the Secretary of State on 2 April 1976.

Area covered:

  • much of the coastal rural area

Works/use covered:

  • the use of land in excess of the areas mentioned in the subjoined table for the purpose of selling or disposing of goods therefrom.

The table:

  1. The use of land of an area of less than 2,025 square metres (excluding land used for car parking purposes in connection with the said use) being land to which any order made under Section 51 of the Shops Act 1950 applies on a Sunday.
  2. The use of land of an area of less than 1,350 square metres (excluding land used for car parking purposes in connection with the said use) on a Sunday, in any case not falling within paragraph l of this table.
  3. The use of land of an area of less than 9,000 square metres (excluding land used for car parking purposes in connection with the said use) on any day of the week except Sunday.

Approved by the Secretary of State on 10 April 1987.

Area covered:

  • a large area of land around the CSOS including land in the National Park

Works covered:

  • Development within Class l(1), (3) and (5);
  • Class IV(1) and (2);
  • Class VI(1);
  • Class VII;
  • Class VIIII(1) (iii);
  • Class XVIII(C) (iv) and (D) (ii);
  • Class XXIV; and
  • Class XXV of the 1977 General Development Order.

As the 1977 General Development Order is now obsolete, the full description of works covered, referred to in the Schedule to the Direction, is included in Annex 1.

Scarborough St Nicholas Cliff and Olympia - restriction on painting of buildings

Approved by the Secretary of State on 8 January 1996.
