Updates

June 2026: Examination to reopen

Following changes to the legal requirements that neighbourhood plans are required to meet, we have asked the independent examiner to reopen the examination of the Terrington neighbourhood plan.

The examiner will consider whether the plan meets the updated legal requirements and prepare a further report with additional recommendations, if necessary.

To inform the examination, Terrington Parish Council will prepare an addendum to the previously submitted Basic Conditions Statement, setting out how the plan meets the updated requirements.

We will arrange a further focused consultation on the Basic Conditions Statement addendum so that interested parties can comment on whether the plan meets the updated requirements.

Comments received will be considered by the examiner. The consultation will take place in due course and further information will be added to this page.

April 2026: Amended legal requirements

Sections 98 and 99 of the Levelling-up and Regeneration Act (LURA) 2023 came into force on 25 March 2026. These have refined the ‘basic conditions’ and other legal requirements that neighbourhood plans are required to meet.

We are considering the implications of the updated legislation for the independent examination of the Terrington neighbourhood plan. A further update will be published in due course.

19 February 2026: Examiner’s report issued

The independent examiner has issued a report on the  Terrington neighbourhood plan proposal (pdf / 546 KB). The report concludes that, subject to a series of recommended modifications, the neighbourhood plan meets the ‘basic conditions’ and other legal requirements and can proceed to referendum.

We will now consider the report and publish a decision statement (Regulation 18) setting out our response to each of the modifications that the examiner has recommended as necessary and our determination as to whether the plan meets the legal requirements and can proceed to referendum.

16 December 2025 to 26 January 2026: Exchange of queries and responses

The examiner has written to North Yorkshire Council and Terrington Parish Council with several questions seeking clarification.

16 December 2025

The council has received confirmation from the examiner, Tony Burton, that the examination of the neighbourhood plan has commenced. Mr Burton has advised that, after a high-level assessment of the plan documents, there are no ‘fatal flaws’. Queries have been received by ourselves and Terrington Parish Council and responses will be published in due course.

21 November 2025: Neighbourhood plan examiner appointed

Tony Burton has been appointed to conduct an independent examination of the proposed Terrington neighbourhood plan. The examiner will consider whether the plan meets the ‘basic conditions’ and other legal requirements and prepare a written report with recommendations. The examination is expected to begin imminently.

31 July 2025: Consultation on a proposed Terrington neighbourhood plan

We are consulting on a proposal for a Terrington neighbourhood plan.

In accordance with Regulation 16 of the Neighbourhood Planning (General) Regulations 2012, the consultation is taking place to bring the plan proposal to the attention of those who live, work or carry on business in the parish and to allow any interest parties to make representations.

The consultation is taking place from Thursday 31 July to 11.59pm on Thursday 25 September.

The proposed neighbourhood plan, supporting documents and further information about the consultation, including how to take part and where documents can be viewed, is available on our planning policy consultation portal.

Following the consultation, we will arrange an independent examination of the plan. All representations received during this consultation will be sent to an independent examiner who will consider whether the plan meets the ‘basic conditions’ and other legal requirements. Further information about the examination will be added to this page following the consultation.

4 April 2025: Neighbourhood Plan submitted to local planning authority

Terrington Parish Council successfully submitted a neighbourhood plan and supporting documents to North Yorkshire Council.

After a checking exercise, as a local planning authority, our duty is to arrange a consultation of no less than six weeks. The comments received will form the basis of an independent examination of the plan.

The consultation will take place in July 2025. 

16 September 2024: Consultation on pre-submission draft neighbourhood plan

Terrington Parish Council consulted on a pre-submission draft of their neighbourhood plan. This consultation related to regulation 14 of the Neighbourhood Planning General Regulations 2012.

The pre-submission draft was developed following informal public engagement and included draft policies that the parish council wished to see put in place, as well as information to justify the policies.

The consultation took place for six weeks between Monday 16 September and Sunday 27 October.

18 May 2023: Neighbourhood area designation

Following an application from Terrington Parish Council, North Yorkshire Council formally designated a Terrington neighbourhood area. The parish council would then begin to develop a neighbourhood plan with the local community.
