Environmental health privacy notice

This Privacy Notice is designed to help you understand how and why North Yorkshire Council processes your personal data. This notice should be read in conjunction with our corporate privacy notice.

Who are we?

North Yorkshire Council is a ‘data controller’ as defined by Article 4(7) of the UK General Data Protection Regulation (UK GDPR). North Yorkshire Council administer, enforce, regulate and advise on environmental health law which includes the following:

  • statutory nuisance

What personal information do we collect?

In order to carry out its statutory functions, in relation to environmental health, the Council will collect the following personal data:

  • name
  • address
  • contact details (email address and telephone number)
  • medical details (infectious disease investigation)
  • qualifications and occupations
  • nationality
  • ownership of land, premises or property
  • bank accounts and other financial details (public health funerals)
  • family details and other relationships where necessary (public health funerals)

Why do we collect your personal information?

We use your information for the purpose of performing any of our statutory enforcement duties, protecting public health and for maintaining and publishing relevant public registers when we are required to by law. We use this information about you to process:

  • statutory inspections of premises or processes
  • applications for permits, registrations or certificates
  • notifications of certain infectious diseases
  • legal proceedings in cases of non-compliance with legislation

Who do we obtain your information from?

We may receive information from a number of other agencies such as:

  • police
  • hm revenues and custom
  • home office immigration
  • NHS services
  • food standards agency
  • health & safety executive
  • environment agency
  • department for environment and rural affairs
  • uk health security agency
  • drinking water inspectorate
  • other local authorities as well as members of the public

Certain information about businesses (including your name and the address of any premises that relates to a business) may be published on a public register on our website when we are required to by law.

What is our lawful basis for processing your information?

North Yorkshire Council relies on the following lawful basis to process your personal data:

UK GDPR Article 6 (1) (c) – processing is necessary for compliance with a legal obligation to which the controller is subject. For the processing of personal data relating to criminal convictions and offences, processing meets Schedule 1, Part 2 of the Data Protection Act 2018 as below:

UK GDPR Article 6(1)(e) – processing is necessary for the performance of a task carried out in the public interest.
