Waste services privacy notice

This privacy notice is designed to help you understand how and why North Yorkshire Council processes your personal data. This notice should be read in conjunction with our corporate privacy notice.

Who are we?

North Yorkshire Council is a ‘data controller’ as defined by Article 4(7) of the UK General Data Protection Regulation (UK GDPR).

North Yorkshire Council are responsible for facilitating commercial and household waste and recycling collections, and the operation of household waste recycling centres (HWRCs). This notice provides details of how the council’s waste and recycling services collect and use information about you.

What personal information do we collect?

In order to manage our waste and recycling services, we may collect the following personal data:

  • name
  • address
  • contact details including telephone number and email address
  • any information you provide to us to facilitate service provision for example, details you submit in an online request
  • details of any payments made
  • vehicle details
  • waste carriers registration number (where required)

Our household waste recycling centres are also fitted with automatic number plate recognition (ANPR) cameras to record vehicle registration numbers and related relevant date and time information. Closed-circuit television is also used to help us manage the household waste recycling centres.

We may also collect the following special category data:

  • medical information to facilitate service provision for example, assisted bin collection

Why do we collect your personal information?

North Yorkshire council collect and process your personal data in order to carry out and maintain the following services:

  • waste and street scene services
  • assisted bin collections
  • clinical waste collections
  • pest control services
  • dog warden services
  • commercial waste and recycling services
  • to manage our contract with you or your business for these services

Your data is collected so we can comply with our responsibilities under the environmental protection act 1990. This includes ensuring that when we accept commercial or household waste on to a household waste recycling centre that is disposed of by other than residents, we obtain a written description of that waste (duty of care) and are able to record charges made if appropriate.

To reduce the amount of commercial waste being disposed of as household waste we operate a commercial/commercial like vehicle (vans) proof of registration scheme at our household waste recycling centres. To manage this, additional information (for example, vehicle registration number) will be recorded and associated with your other personal information to allow residents to deliver their own household waste in a van without charge.

Our household waste recycling centres are equipped with automatic number plate recognition (ANPR) cameras. This is a responsibility we have in order to carry out the above statutory duties and responsibilities and to assist other agencies in the detection and prevention of crime.

Closed-circuit television is also used to help us manage the household waste recycling centres. This is predominantly to protect the security of staff and the property but is also used to help us deal with complaints and to assist other agencies in the detection and prevention of crime.

Who do we share this information with?

We may be required to share your information with some third party organisations, including:

  • the environment agency
  • driver and vehicle licensing agency (DVLA)
  • contractors where we have outsourced clinical and commercial waste collection
  • North Yorkshire fire and rescue for assisted bin collection services

ANPR recordings

If not required for evidential purposes, kept for 31 days prior to reuse or destruction. If required for evidential purposes, will be Retained from year records created for 6 years.

Closed circuit television recordings

If not required for evidential purposes, kept for 31 days prior to reuse or destruction. If required for evidential purposes, will be Retained from year records created for 6 years.

What is our lawful basis for processing your information?

North Yorkshire Council relies on the following lawful bases to process your personal data:

  • UK GDPR Article 6 (1)(c) – processing is necessary for compliance with a legal obligation to which the controller is subject
  • UK GDPR Article 6 (1)(e) – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller

The Council will also rely on the following lawful basis when processing your personal data in relation to the provision of its commercial waste services:

  • UK GDPR Article 6 (1)(b) – processing is necessary for the performance of a contract

When processing special category data, the council will rely on the following lawful basis:

UK GDPR Article 9(2)(g) – The processing of your special category data is necessary for reasons of substantial public interest (with a basis in law), meeting Schedule 1, Part 2 of the Data Protection Act 2018 as below:

  • (16) Support for individuals with a particular disability or medical condition
