Home energy upgrades privacy notice

This privacy notice is designed to help you understand how and why North Yorkshire Council processes your personal data. This notice should be read in conjunction with our corporate privacy notice.

Who are we?

North Yorkshire Council is a ‘data controller’ as defined by Article 4(7) of the UK General Data Protection Regulation (UK GDPR). The housing service is a function of North Yorkshire Council within the community development directorate, and its functions include the delivery of home energy upgrades for local residents.

What personal information do we collect?

The council will collect the following personal data in relation to home energy upgrades:

  • name
  • address
  • contact details (telephone number and email address)
  • financial information including pay slips, pension details and any benefit entitlements
  • proof of property ownership
  • your landlord’s name and contact details
  • property information
  • planning information

Why do we collect your personal information?

We collect your personal information in order to deliver home energy upgrades through the Home Upgrades Grant Phase 2 and other home energy improvement projects. This may include:

  • any statutory requirements associated with the project, such as financial assessments
  • the use of third parties to verify the information you have provided or gather further information to complete the assessment of your application

Who do we obtain your information from?

In addition to information received directly from you, we may also collect information from:

  • the Customer, Revenue and Benefits service within North Yorkshire Council 

Who do we share this information with?

We may share this data internally with our Customer, Revenue and Benefits service in relation to your eligibility.

In order to manage and deliver the projects, we may need to share relevant information with external parties to the council, including:

  • management and delivery contractors and sub-contractors 
  • Department for Energy Security and Net Zero, and any other relevant government departments
  • your landlord

We may share information that is given to us with other organisations that inspect or handle public funds to prevent and detect fraud including:

  • Department for Works and Pensions
  • HM Revenues and Customs
  • Department for Energy Security and Net Zero, and any other relevant government departments
  • National Audit Office
  • Cabinet Office
  • the police
  • registered social landlords

What is our lawful basis for processing your information?

North Yorkshire Council relies on the following lawful basis to process your personal data:

  • UK GDPR Article 6 (1)(e) – processing is necessary for the performance of a task carried out in the public interest

When processing special category data, the council will rely on the following lawful basis:

  • UK GDPR Article 9 (2) (g) – processing is necessary for reasons of substantial public interest with processing meeting schedule 1, part 2 of the data protection act 2018 as below:
  • (16) support for individuals with a particular disability or medical condition

The legislations, policies and guidance that relate to this service includes, but is not limited to:

  • housing grants, construction and regeneration act 1996
  • regulatory reform (housing assistance) (England and Wales) order 2002
  • the housing renewal grants (England) regulations 2009
